To protect the integrity of Blacklab's servers and network, and ultimately, in the interests of the majority of legitimate and fair-minded users, Blacklab asks all users to acknowledge acceptance of the following terms and conditions before committing to purchase a service.

Blacklab Hosting "Blacklab" provides web hosting and email services. Blacklab reserves the right to suspend or cancel any client's access to any portion or all of Blacklab services, when Blacklab deems that the account has been used inappropriately. Blacklab reserves the right to refuse service and/or access to its servers to anyone.

1. User Policy

Blacklab prohibits sites engaged in Illegal activities including but not limited to storing and/or distributing illegal copies of copyrighted software, warez sites, violations of copyrights and trademarks, violations of UK laws, selling and/or distributing illegal contraband. Internet abuse including but not limited to spamming - mass unsolicited Emailing, distribution of mass emailing programs, cross-posting messages to a large number of usenet groups, posting obscene or inflammatory messages, threatening other Internet users, mail bombing Internet users, running packet sniffers or port scanners and spamming. Systems abuse including but not limited to use of excessive CPU resources, use of excessive disk space, use of excessive email storage space, hacking our systems, installing continuously running programs, such as IRC bots, reselling CGI scripts or web space.

2. Obscene content

Blacklab prohibits sites engaged in obscene content and from using Blacklab's network to advertise, transmit, store, post, display, or otherwise make available child pornography or obscene content. Blacklab will notify law enforcement agencies when it becomes aware of the presence of child pornography on or being transmitted through it's network.The determination of what is "obscene" and prohibited shall be solely made by Blacklab.

3. Policy Violation

Should a policy violation occur, Blacklab reserves the right to terminate the account without notice and without any refunds. The policy violating client will be held responsible for any damages to Blacklab, including but not limited to, Blacklab's system, servers, connectivity, reputation, business, service, network, operations, or equipment. The policy violator may be charged a clean up fee not exceeding £100.

4. Web Site Content

Whilst Blacklab will make all effort to ensure no loss of data by a policy of frequent backups (at least every 24 hours) the client is ultimately responsible for keeping a copy of their most current web site files as backup on a remote system. Blacklab is not responsible for any lost files, information, or data.

5. Support Customer

Support is provided via a national rate number - 01634 400140.

6. Payment Policy

An annual subscription fee is required before the account is activated which can be paid either annually in advance or by monthly installments by credit card or standing order. The annual fee is non-refundable after the expiry of the 30 calender day guaranteed cancellation period. Blacklab reserves the right to change prices at any time after expiry of the annual subscription period by giving no less than 30 calender days prior notice.

7. Account Cancellation

Blacklab reserves the right to terminate service at any time. If an account is terminated for a policy violation there will be no refund. Blacklab reserves the right to delete the policy violating web site content without notice. Customers can cancel service at any time. All account cancellations are requested in writing. Blacklab is not responsible for the site being transferred to another Service Provider or Servers if an account is cancelled due to non-payment.

8. Indemnification

The client agrees to defend, indemnify and hold harmless Blacklab against any liabilities arising out of defective products sold to customers from Blacklab servers, personal injury or property damage caused by products or services sold or distributed from Blacklab servers, any material that infringes or allegedly infringes on the rights of a third party available from Blacklab servers, and any material that libels or allegedly libels a third party available from Blacklab servers.

9. Disclaimer

Blacklab is not responsible for any damages to any client's business. Blacklab makes no warranties or guarantees of any kind, expressed or implied for services provided. Use of Blacklab's web hosting and email service is at the client's sole risk. Blacklab's services are provided on an "as is, as available" basis. Blacklab does not guarantee that its services will be uninterrupted or error free. Blacklab will provide every effort in good faith to ensure that its services are available to as many Internet users as possible with minimal service interruptions. In no circumstance will Blacklab be liable for any claims resulting from the use or inability to use Blacklab's services - including, but not limited to, service interruptions, client errors, Internet connectivity problems, miscommunications, unauthorised access to Blacklab servers, InterNIC/Nominet problems, DNS caching, Internet bandwidth congestion, power failures, vandalism, and natural disasters.

9. Blacklab reserves the right to revise its policies at any time.

Blacklab reserves the right to revise its policies at any time by giving 60 days due notice of such revision to its clients. If any such revision is unacceptable to the client, the client may, under the terms of clause 7 above, give notice to cancel the service.
